Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DecorAI ("Company," "we," "us," or "our") governing your access to and use of our AI interior design application and website at aihomedesign.app (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.

Description of Service

DecorAI provides AI-powered interior design services that allow you to:

• Upload photos of rooms and spaces
• Generate AI-powered design transformations and visualizations
• Access AI floor planning tools
• Create exterior and garden design visualizations
• Save and organize your design projects
• Export and share your designs

The Service uses artificial intelligence technology from third-party providers including OpenAI and Google Gemini. Results may vary and are intended for visualization and planning purposes only.

User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

Subscription and Payments

Subscription Plans

We offer various subscription plans including:

• Free Trial: Limited features with no payment required
• Pro Monthly: $14/month with full access to all features
• Pro Yearly: $97/year (best value) with all features plus priority support

Billing

Subscriptions are billed in advance on a recurring basis (monthly or yearly). Payment is processed through RevenueCat and Apple/Google payment systems. By subscribing, you authorize us to charge your payment method automatically.

Cancellation

You may cancel your subscription at any time through your account settings or the App Store/Google Play. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You will not be charged for subsequent periods
• No partial refunds are provided for unused time

Refund Policy

We offer a 7-day money-back guarantee for new subscribers. If you are not satisfied within 7 days of your first payment, contact us for a full refund. After 7 days, refunds are at our sole discretion and handled through the respective app store.

User Content and Intellectual Property

Your Content

You retain all ownership rights to the photos and content you upload ("User Content"). By uploading content, you grant us a limited, non-exclusive license to:

• Process your photos through our AI systems to provide the Service
• Store your content to enable your use of the Service
• Display your content back to you within the application

We do not claim ownership of your photos or sell them to third parties.

AI-Generated Content

Design visualizations generated by our AI ("Generated Content") may be used by you for:

• Personal home design and planning
• Sharing with contractors, designers, or family members
• Commercial use (Pro subscribers only) including client presentations and social media

Our Intellectual Property

The Service, including its original content, features, functionality, branding, and AI technology, is owned by DecorAI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

Prohibited Uses

You agree not to use the Service to:

• Upload content you do not have the right to use
• Upload illegal, harmful, or objectionable content
• Attempt to circumvent security measures or access restrictions
• Use automated systems to access the Service without permission
• Interfere with or disrupt the Service or servers
• Violate any applicable laws or regulations
• Impersonate another person or entity
• Collect user information without consent
• Use the Service to develop competing products
• Resell or redistribute the Service without authorization

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of AI-generated designs
• Uninterrupted or error-free service

AI-generated designs are for visualization purposes only. We do not guarantee that designs will be structurally sound, compliant with building codes, or suitable for actual construction. Always consult with qualified professionals before making renovation decisions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECORAI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account
• Damages resulting from third-party conduct or content

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless DecorAI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through:

• Informal Resolution: Contact us first to attempt to resolve disputes informally
• Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
• Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• Provisions that should survive termination will remain in effect

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
